1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the MoodBox mobile application ("the App"), published by NextrendX ("we," "us," "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Description of Service
MoodBox is a free content-viewing application that lets you browse jokes, recipes, stories, wallpapers, and videos published through our content team. The App is provided for personal, non-commercial, entertainment use.
3. No Account Required
MoodBox does not require registration, login, or any personal information to use. Features such as Favorites are stored locally on your device only. Since there is no account, we have no ability to identify individual users, and these Terms apply to your use of the App generally rather than to a specific registered account.
4. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use. This license does not permit you to:
- Copy, modify, or create derivative works of the App itself
- Reverse-engineer, decompile, or disassemble the App
- Rent, lease, sell, sublicense, or otherwise redistribute the App
- Remove or alter any proprietary notices on the App or its content
- Use any automated system (bot, scraper, crawler) to access the App's content or servers at scale
5. Intellectual Property
The App itself (its design, code, logo, and branding) is owned by NextrendX and protected by applicable intellectual property laws. The jokes, recipes, stories, wallpapers, and videos displayed within the App ("Content") are either:
- owned or licensed by us for distribution through the App, or
- sourced from contributors/creators who have granted us the right to publish and display that Content within MoodBox.
Content is provided for your personal viewing, and where a specific post explicitly allows saving or sharing (indicated by a Save/Share option being available), you may save it to your own device or share it for personal, non-commercial use only. You may not claim authorship of Content, resell it, or use it for commercial purposes without separate written permission from us or the applicable rights holder.
6. Acceptable Use
You agree not to use the App to:
- Violate any applicable local, state, national, or international law
- Interfere with or disrupt the App's servers, infrastructure, or other users' access to the App
- Attempt to gain unauthorized access to any part of the App, our systems, or our admin infrastructure
- Redistribute App Content at scale (e.g. republishing our entire content library on another platform)
7. Copyright Complaints
We respect the intellectual property rights of others and expect our content team to do the same when publishing to the App. If you believe that any Content available in MoodBox infringes your copyright, please send a notice to moodbox.trend@gmail.com including:
- A description of the copyrighted work you believe has been infringed
- The specific location (post title/category) of the material within the App
- Your contact information (name, email, and, if applicable, phone number)
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
Upon receiving a valid notice, we will promptly investigate and, where appropriate, remove or disable access to the reported Content.
8. Third-Party Services & Links
The App uses Cloudinary to host and deliver images and video thumbnails, and may contain links to third-party services (for example, YouTube for video playback, or our social media pages). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of any third-party service is governed by that service's own terms and policies.
9. Disclaimer of Warranties
The App and its Content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Recipe content is provided for general informational/entertainment purposes only and is not professional dietary, medical, or nutritional advice — use your own judgment, especially regarding allergies or dietary restrictions.
10. Limitation of Liability
To the fullest extent permitted by applicable law, NextrendX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us to use the App (which, for the current free version, is zero).
11. Termination & Availability
We may suspend or discontinue the App, or any part of it, at any time, with or without notice. Since the App requires no account, "termination" of your individual access simply means uninstalling the App from your device, which you may do at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
12. Changes to the App or Terms
We may update the App (including its features and available Content) and these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date above. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.
